Charged with Passing Bad Checks?

Whether you made a mistake in writing a bad check or your bank or employer were at fault for the bounced check, the consequences can be severe. Often, a bounced payroll check from an employer will cause a person to write a bad check, not realizing that their paycheck will not clear. Other times, a simple mistake in personal accounting will make someone believe that they have more money in their account than they originally thought. In any case, check fraud charges may be brought upon the offender, possibly resulting in a hefty fine and even jail time.

The penalty for passing bad checks depends on a couple of factors, mostly the amount of the check. You may either be charged with a misdemeanor or a felony.

  • MISDEMEANOR
    • If you’ve written a check from your own active checking account for an amount less than $500, you may be charged with a Class A Misdemeanor. In this case, you may face up to one year in jail, as well as a large fine.
  • FELONY
    • A Class C Felony charge may be brought upon you if you write a bad check of more than $500, or if write a check from a bank where you do not hold an active account. The penalty for felony check fraud is much higher than the penalty for a misdemeanor. You may face up to seven years in prison.
